STATEMENT BY GREGORY G. GIANTORCARO, ESQUIRE ON PATERSON DIOCESE LEGAL MOTION CONCERNING TWENTY-FIVE (25) CHILD SEXUAL ABUSE CASES

Phillipsburg, New Jersey/June 28, 2004 - Attorney Gregory Gian.forcaro today issued. the following stat:em.ent on. a. Motion to Dismiss flied by the Diocese of Paterson., New Jersey, in. the Morris County Superior Court, against twenty-five (25) people who were sexually abused as children in the Paterson Diocese. The .Motionn alleges that the Statute of Limitations has expired and. that the Plaintiffs should have filed suit within two (2) years of the date they turned. eighteen (18) years of age.

"This action. by the Pa.terson. Diocese is expected., though. not Christian.-like. Ever since the Roman Catholic Church's child sexual. abuse scandal became public in. early 2002, the Paterson. Diocese has been, unwilling to settle, despite these felonious crimes perpetrated by their priests. As a. result, they have si.mpl.y emboldened my clients and. fueled their resolve,

"My clients are, as a. result of this Motion., resolved. andd determinedd to gain justice from. the New Jersey Courts, no matter how long it takes. The Diocese's unwillingness to fundamentally change, more than. two (2) years after the sexual abuse scandal. broke, is exactly why this Diocese is in the position that it is in today."

"In. fact, I will be able to prove that die Diocese knew of most off these crimes and. did. not report them. to law enforcement, This Diocese does not get it and does not want to get it when. it comes to helping victims and preventing future crimes against children.

"As far as the legal. issues are concerned, with. respect to the Statute of Limitations, what the Diocese past leadership does not understand is that in. cases involving the sexualJ abuse of children, the victims/survivors typically either repress their memories until adulthood or do not make the connection until adulthood that the abuse they sustained as children is connected to damages they have suffered. as adul.l:s. In. either situation., the abuse has had. devastating and permanent effects that children are just not able to deal withh or understand. when they turn eighteen. (1.8). New Jersey Law clearly stales that the Statute of Limitations shall not toll until. either the memories of the abuse surface or the connection is made between. the abuse and. the damages." "In twenty (20) of the twenty-five (25) cases in. which. the Diocese is requesting that the matters be dismissed, there is no doubt that the abuse took place or that its effects have been. quite serious, as Father James T. Iianley has admitted, in. considerable graphic detail., to his abuse of approximately twenty (20) Plaintiffs. One (1) other case involves the sexual abuse by Monsignor Jose Alonzo who, based uponn what has been previously reported (including recent items within. the past few weeks), the Paterson Diocese appears to have known. that he was abusing children and did. not take appropriate action. to stop him."
